Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and novelty within the sport emboldened his effort with 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Financial Stakes and a Will to Win
Jordan shared operational insights of his 23XI team, revealing he put in $40m of his personal wealth into the Cup Series operation launched with partner Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
Central Issue: Franchise System and Contract Pressure
The heart of the case involves the end of a 2016 agreement where Nascar granted each team a franchise. This system mirrors other major leagues with separately owned franchises, like the Charlotte Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a glimpse or a photo of the sports legend.
Spearheading the Fight
23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a operating model Jordan contended is unlawful to maintain excessive control.
For Jordan and and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a frantic and emotional six hours where the racing circuit informed teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages detailing pay for chartered teams and a guaranteed spot in Nascar-sponsored races.
Choosing Litigation
Jordan said that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that extensive document and litigate the matter. The other 13 organizations agreed to the terms.
Jordan and co-owner Denny Hamlin approached Nascar about possible changes or extension options. Nascar refused to engage, according to his testimony.
The Ultimate Motivation: Victory
Ultimately, the resistance against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.
“Denny convinced me getting a third driver boosted our odds of winning,” he said, noting that he bought a third charter last year for $28m amid the legal dispute. “So I took the plunge.”
Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, which she said a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.
She said, the team founder first tried to call and talk Nascar out of demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s executives. The response was, “If I wake up and I have 20 charters, that’s what I have. If I have 30, that’s the number.”
