US Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

Legal proceedings

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to face human smuggling charges, he was detained in immigration detention.

In her decision, the judge noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The court challenge involve disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.

Conditions of Freedom

The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.

This ruling represents a significant turn in a complicated immigration case featuring claims of wrongful detention and disputed gang affiliations.
